Beneficiaries Don’t Always Get Along
Every day we come across attorneys whose clients are fighting over money. In most cases it’s not even money they worked for; it’s money they inherited. Oftentimes, the money, and other assets, are held in trust for the family. Usually, the family’s parents or grandparents worked very hard to accumulate generational wealth in order to provide for them.
The generational wealth that was put in trust might include real estate, stocks, rental properties, businesses, or any number of other assets. The scions of the originator of the trust don’t always agree on how the assets should be distributed. Or, more accurately, how the proceeds of the assets should be distributed.
To make matters even more complicated, a family member or close trusted friend of the deceased may have been appointed trustee over the trust. They may have been appointed as trustee for sentimental reasons and have no actual experience with trust administration and management. While we all understand the sentiment of appointing someone we trust, most laymen are not qualified to manage a trust, much less a trust of extreme net worth.
In the worse case scenario, the trustee may control the trust and may be using its assets for their own best interest rather than the best interest of the family member beneficiaries.
While this scenario, in and of itself, does not necessarily portend the demise of the assets in trust. If the trustee is not 100% impartial or if the trustee does not know how to manage the assets in the trust, the assets of the trust may be mismanaged and in danger of depreciation.
We Offer Your Client Peace of Mind
Our focus is on attorneys who represent clients who have created a legacy of generational wealth for their families. Clients who may have created a portfolio of real estate, business, stocks, and other assets for the benefit of their loved ones and want to ensure the longevity of their legacy.
The Trustee Group offers your clients the peace of mind in knowing that their legacy will be well managed and their family will be well taken care of with what they have created. We are experienced professional administrative trustees, and impartial licensed Private Professional Fiduciaries and National Certified Guardians.
We are well qualified to ensure your clients’ desire to provide for their family is fulfilled.
Experienced Trustees Can Mediate Family Disputes
Once The Trustee Group is appointed as Trustee over your client’s trust, we can step in whenever an inexperienced or incompetent trustee has been appointed trustee over a trust. We can step in when there’s fighting amongst the beneficiaries of the trust. We can step in when the current trustee is accused of using assets of the trust for their own best interest.
Families should NOT have to fight over the assets in the trust. They should not have to worry about the value of the assets in the trust. They should have the peace of mind knowing that the assets of the trust are in good hands and all the beneficiaries are being treated fairly and equitably. The trustees of The Trustee Group have experience dealing with the aftermath left by less than qualified trustees. We are experienced mediators who can diffuse volatile situations when family members fight, and we can explain, in laymen’s terms, what might otherwise be confusing to unknowledgeable beneficiaries.
Specifically, those families who are arguing over the value of the trust and the distribution of the assets and need a neutral party with experience to manage and preserve the estate. They need an experienced mediator who can help the family reach the best resolution for everyone involved. Families are together long term, especially if there is a lot of money and property to go around. Of course, that doesn’t mean they don’t fight and argue. Perhaps everyone wants a particular asset. The Trustee Group makes sure that all beneficiaries are treated as ascribed in the trust documents.
